I was looking into the nature of email disclaimer
verbiage recently
and discovered that an email disclaimer does not
necessarily provide bullet proof protections. Apparently
putting a disclaimer on material that is not really
important or private effectively dilutes your claim of
confidentially. Cheryl Hall of the Dallas Morning News
put together an excellent summary of this issue with the
help of Peter Vogel of
Gardere Wynne Sewell LLP. According to Vogel, a
disclaimer should only be put
on items that truly warrant the notice. He recommends
business people communicate directly when sensitive
subjects are being discussed. He also goes on to warn…
"If a jury hears something once, they may or may not
believe it. If they hear it a second time, they start
believing it's
possible. But if they see an e-mail that's the size of a
wall in a courtroom, they absolutely believe it's true."
